Working Time Rules: Philippines
Philippines: standard working hours, overtime, rest, annual leave, and record-keeping rules - a practical overview, not legal advice.
Statutory working time
Under the Labour Code of the Philippines (Art. 83), normal working hours may not exceed 8 hours per day. Art. 87 requires overtime pay of at least 25% above the regular hourly rate for hours worked beyond 8 hours in a day.
Overtime
Work beyond eight hours a day is paid at the regular wage plus at least 25%. Overtime worked on a rest day or holiday is paid at the rate applying to the first eight hours of that day plus at least 30%.
Rest periods
At least 24 consecutive hours of rest after every six consecutive normal work days. The employer schedules the rest day, subject to any collective bargaining agreement, and must respect an employee’s preference where it is based on religious grounds. Employers must also give at least 60 minutes off for regular meals.
What to check before you rely on this
- The current statutory limits, reference periods, and any opt-outs.
- Sector or collective-agreement rules that may override the defaults.
- How overtime is authorised, recorded, and compensated.
- What working-time records you must keep and for how long.
